<p>Medical marijuana and medical marijuana dispensaries have become a hot topic recently, and in recent years fourteen states have enacted laws legalizing medical marijuana in one form or another. While the best known is California, states like Colorado, Hawaii, Alaska, Montana, Oregon, Rhode Island, Washington, and New Jersey have legalized medical marijuana and have several dispensaries serving patients on a regular basis. <p>A medical marijuana dispensary is a location where a patient or a patient&#8217;s caregiver, only with a doctor&#8217;s prescription and proper identification card, can obtain medical grade marijuana from a reliable and legal source. Marijuana has been used medicinally for centuries across many diverse cultures, but it was not until recent times that organized dispensaries and marijuana&#8217;s medicinal benefits were taken seriously.</p>
<p>Marijuana has been used to treat a wide range of ailments and conditions from anxiety and depression to insomnia and Crohn&#8217;s disease. Marijuana has long been known to relieve pain and sickness associated with cancer, HIV, AIDS, and their treatments.</p>

<p><strong>Fines and Penalties for medical Marijuana use in Arizona </strong></p>

<p>Under current Federal Law, the <strong>use, sale</strong> or <strong>possession</strong> of <strong>marijuana (pot),</strong> paraphernalia, whether medically prescribed or not, it is still unlawful and carries significant criminal penalties in Arizona. This may change after Arizona voters go to the polls in November 2, 2010 to vote on a popular <strong>Medical</strong> <strong>Marijuana </strong>initiative.  In the mean-time, criminal charges related to <strong>medical marijuana</strong> remain a serious offense in Arizona. Currently, there is no distinction in penalties for using <strong>medical Marijuana</strong> v <strong>Marijuana</strong> for non-medical or recreational use. As is with DUI charges, Arizona has some of the toughest laws against <strong>Marijuana</strong> in the Country, even for simple possession.</p>
<p>For now, below are the penalties for<strong> Marijuana</strong> <strong>Possession</strong>in Arizona whether for medical use non-medical use. The Arizona Drug charge classification for a marijuana offense depends mostly on how much of the substance is found in your possession.   </p>
<p><strong>If the amount of marijuana is: Then the potential sentence is: </strong><br /> Less than 2 pounds (not for sale)                         1 year in prison (Class 6 felony) </p>
<p> Between 2 and 4 pounds (not for sale)                1 ½ years in prison (Class 5 felony) </p>
<p> More than 4 pounds (not for sale)                        2 ½ years in prison (Class 4 felony) </p>
<p> Less than 2 pounds (intent to sell)                        2 ½ years in prison (Class 4 felony) </p>
<p> Between 2 and 4 pounds (intent to sell)               3 ½ years in prison (Class 3 felony) </p>
<p> More than 4 pounds (intent to sell)                       5 years in prison (Class 2 felony)  </p>
<p> Less than 2 pounds (that you produced)               1 ½ years in prison (Class 5 felony) </p>
<p> 2-4 pounds (that you produced)                            2 ½ years in prison (Class 4 felony) </p>
<p> More than 4 pounds (that you produced)              3 ½ years in prison (Class 3 felony) </p>
<p> Less than 2 pounds (transporting into AZ)           3 ½ years in prison (Class 3 felony) </p>
<p> More than 2 pounds (transporting into AZ)          5 years in prison (Class 2 felony </p>
<p> In addition to prison time to your Arizona <strong>Marijuana drug sentencing,</strong> you will face large fines for your <strong>marijuana conviction</strong>. The minimum fine you will pay is 0. However, if the value of the marijuana you were caught with exceeds 0, your fine will equal 3 times that amount, not exceeding 0,000.</p>
<p>Due to the fact that Marijuana is legal with restrictions and limitations in 14 other states, many people either view medical marijuana charges as possibly legal or in the least minor criminal charges. However, Arizona law and its prosecution do not view it this way. You may be facing a life changing incarceration and high dollar fines depending on how much was found in your possession.  So for now, in Arizona, if you wish to use medical Marijuana or non-medical Marijuana, you have at these three options:</p>
<p>1)      Use medical Marijuana if you have no other medicinal alternative. But at least understand   the extreme risks and harsh penalties, fines and incarceration that still exist in Arizona as a consequence as of this date.</p>
<p> </p>
<p>2)      Consult your Physician about the possibility of using alternative treatments or medications for relief of your medical symptoms, at least temporarily; wait until after November 2, 2010, when Arizona Voters go to the polls.  Perhaps new Medical Marijuana Laws will be passed in favor of qualified use of medical Marijuana to help relieve the symptoms of your medical condition or illness.</p>
<p> </p>
<p>3)      Move to any of the following 14 States who have laws either broad or limited legalization of medical Marijuana<strong>:</strong></p>
<p>Alaska, California, Colorado, Hawaii, Maine, Michigan, Montana, Nevada, NewJersey, New Mexico, Oregon, Rhode Island, Vermont, Washington. All 14 states <strong>do </strong>require proof of residency in their respective state as a qualifying factor to use medical Marijuana<strong>. </strong></p>

<p>This fall of 2010 the state of Oregon will be voting on whether to allow medical marijuana dispensaries to form throughout the state. This would allow for thousands of people throughout the state to finally be able to legally obtain medicinal marijuana to relieve their chronic pain or chronic muscle spasm condition.</p>
<p>Currently, patients need to either grow their medicinal pot or have someone grow it for them-for free. The state does not allow for any money to be transacted with the dispensing of medical marijuana. <br />If this law passes, and Oregon is allowed to offer its marijuana patients medicine through Portland marijuana dispensaries, it would help so many people to suffer less.</p>
<p>I have seen firsthand how much marijuana can help people with medical conditions. My mother suffers from Multiple Sclerosis (MS) and has been using medical marijuana for the last 15 or so years. <br />Marijuana helps my mom to stay relaxed and relatively stress-free. For her, the ability to minimize stress in her life is crucial.</p>
<p>Multiple Sclerosis is a disease of the nervous system in which the body&#8217;s immune system is thought to attack its own nervous system. Her disease is significantly affected by the level of stress in her life. I remember times as a kid when she would get real stressed out one evening and wake up the next morning unable to walk or see. The stress from the evening before had caused an MS attack, essentially shutting off part of her body from the control of her brain.</p>
<p>An MS attack usually causes her to lose some functional ability. There were times my mom couldn&#8217;t walk for months and had to use a wheel chair. Sometimes she would wake up to not being able to see out of one eye or to have both eyes with double-vision which caused her to get very nauseous. Often she would regain her vision or feeling only a few days later, sometimes it took months. That is what is so horrible about MS, when you lose your site or ability to walk, you don&#8217;t know how long you will be that way before you regain it, if ever.</p>
<p>Over the last 15 or years I have noticed a great improvement in my mom&#8217;s MS condition. She still has attacks, just not as often nor severe. Marijuana keeps her relaxed and her nerves down, which she is unable to do without it. Medicinal marijuana has other benefits for her also. She often gets nauseous from having double-vision and smoking pot helps her to keep her food down and to maintain something of an appetite. It has even helped her to get rid of her double vision too</p>
<p>Obviously, marijuana has had some very positive health benefits for my mother. I am sure that many other thousands of people can tell of similar benefits from using the plant. The problem right now though is that my mom and people like her have to enter the black market and risk incarceration trying to buy pot from the neighborhood drug dealer.</p>

Let&#8217;s hope I-28 passes for the sake of my mom and the many other thousands out there like her.</p>
